Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using BackNine (“the App”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

BackNine is a golf social and league management application that provides GPS distances, round tracking, league management, social features, and AI-powered coaching. Features are subject to change at our discretion.

3. User Accounts

You must create an account to use most features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to update it as needed. You must be at least 13 years old to create an account.

4. Subscription Terms

BackNine offers a free tier and a paid Pro subscription. By purchasing a Pro subscription:

  • Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription at any time through your account settings or through the App Store / Google Play Store.
  • Prices are subject to change. We will provide reasonable notice of any price changes before they take effect.
  • Purchases made through the App Store or Google Play are subject to Apple's and Google's respective refund policies. For those purchases, contact Apple Support or Google Play Support directly.
  • Purchases made through our website (playtheback.com) are eligible for a full refund if requested within 7 days of the original purchase date. To request a refund, email contact@playtheback.com with your order details. Refund requests made after 7 days will not be honored.

5. User-Generated Content

You retain ownership of content you post in BackNine (rounds, scores, social posts, league data). By posting content, you grant BackNine a non-exclusive, royalty-free license to use, display, and distribute that content within the App to provide the service. You are solely responsible for the content you post and agree not to post anything unlawful, defamatory, or that infringes on others' rights.

6. Commissioner Responsibilities

League commissioners are responsible for managing their leagues fairly and in accordance with these terms. BackNine provides tools to facilitate league management but does not arbitrate disputes between players. Commissioners may not use their role to harass, discriminate against, or unfairly penalize league members.

7. Prohibited Conduct

You agree not to:

  • Manipulate scores, standings, or activity data
  • Harass, threaten, or abuse other users
  • Use the App for any commercial purpose without written authorization from BackNine
  • Attempt to reverse engineer, decompile, or extract source code from the App
  • Use automated tools, bots, or scrapers to access the App
  • Impersonate another person or entity
  • Upload or transmit malicious code or interfere with the App's operation

8. Intellectual Property

All content, features, and functionality of BackNine — including but not limited to the name, logo, design, code, and text — are owned by BackNine and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, BackNine, or third parties. You may delete your account at any time via Settings > Account > Delete Account in the App. Upon termination, your right to use the App ceases immediately.

10. Disclaimers and Limitation of Liability

BackNine is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability. We are not responsible for data loss, service interruptions, or inaccuracies in GPS or handicap data. To the maximum extent permitted by law, BackNine's total liability for any claim arising from your use of the App is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BackNine, its officers, employees, and partners from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification at least 7 days before they take effect. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Cook County, Illinois.
